With reference to the deposit on 6 January 1995 of the instrument of ratification of the European Convention of 6 November 1990 on the General Equivalence of Periods of University Study, I have the honour to make the following reservation on behalf of the Government of the Federal Republic of Germany:
The Government of the Federal Republic of Germany assumes that recognition under the Convention applies only to the field of higher education and not to access to professions. For these reasons, in respect of admissions to examinations which also permit access to professions regulated by legal or administrative rules or which must be passed before gaining access to such professions, the Federal Republic of Germany will extend such recognition under the Convention only insofar as they correspond to the requirements stipulated by examination regulations in the Federal Republic of Germany.

With reference to the deposit on 6 January 1995 of the instrument of ratification of the European Convention of 6 November 1990 on the General Equivalence of Periods of University Study and to my letter of 15 February 1995 containing a reservation, I have the honour to make the following communication on behalf of the Government of the Federal Republic of Germany :
The reservation was included in the ratification proceedings before the German Parliament. The reservation has been adopted by the Council of Ministers, is set out in the memorandum to the draft Law ratifying the Convention, was the subject of a favourable opinion of the Bundesrat and reflects the corresponding position of the Federal Government.
The late submission of this reservation is due to an omission.

The Swiss Federal Council declares that the competence of cantons in the field of education, as established by the Federal Constitution, as well as the autonomy of universities are reserved for the implementation of the Agreement.
