In accordance with articles 96 and 12 of the United Nations Convention on Contracts for the International Sale of Goods, any provisions of article 11, article 29 or Part II of the Convention that allows a contract of sale or its modification or termination by agreement or any offer, acceptance or other indication of intention to be made in any form other than in writing does not apply where any party has his place of business in the Argentine Republic.

Armenia

1. Pursuant to Article 95 of the Convention, the Republic of Armenia declares that it will not apply the Article 1, subparagraph (1) (b) of the Convention to the parties that declare not to be bound by the Article 1, subparagraph (1) (b) of the Convention.
2. Pursuant to Articles 12 and 96 of the Convention, the Republic of Armenia declares that any provision of Article 11, Article 29 or Part II of this Convention that allows a contract of sale or its modification or termination by agreement or any offer, acceptance or other indication of intention to be made in any form other than in writing does not apply where any party has his place of business in the Republic of Armenia.

Azerbaijan

Belarus

The Byelorussian Soviet Socialist Republic, in accordance with articles 12 and 96 of the Convention declares that any provision of article 11, article 29 or Part II of this Convention that allows a contract of sale or its modification or termination by agreement or any offer, acceptance or other indication of intention to be made in any form other than in writing does not apply where any party has his place of business in the Byelorussian SSR.

Canada

The Government of Canada declares that the declaration made at the time of its accession to the Convention on April 23, 1991, the declaration deposited on April 9, 1992, the declaration deposited on June 29, 1992 and the declaration deposited on July 31, 1992, remain in effect.

The Permanent Mission of Canada to the United Nations presents its compliments to the Secretary-General of the United Nations and has the honour to refer to the United Nations Convention on Contracts for the International Sale of Goods and the Secretary General’s communication of January 2, 2018, C.N.804.2017.TREATIES-X.10, relating to that treaty.
The Permanent Mission of Canada notes that this communication was made pursuant to the Secretary-General’s role as Depositary for this treaty. We also note that it is for State Parties to a treaty, not the Depositary, to make their own determination with respect to any legal issues raised by communications circulated by a depositary.
In that context, the Permanent Mission of Canada wishes to underscore that Canada does not recognize ‘Palestine’ as a State, as it does not meet the necessary criteria of a State under international law. Given that consent to be bound is limited to sovereign States, Canada would like to confirm that it cannot enter into treaty relations with ‘Palestine’ as regards the Convention on Contracts for the International Sale of Goods.
Moreover, in order to avoid any possible misinterpretation, the Permanent Mission of Canada wishes to state that all present and future purported accessions to multilateral treaties, to which Canada is a Party, and for which you are depositary, will not have any legal effect on Canada’s treaty relations with respect to the ‘State of Palestine’, as ‘Palestine’ is not able to accede to those multilateral treaties.
In addition to the above statement, the Permanent Mission of Canada would like to indicate that Canada will continue to look at each purported accession to determine if additional views should be put on the record.
As a friend and ally of Israel and friend of the Palestinian people, Canada is firmly committed to the goal of a comprehensive, just and lasting peace in the Middle East, including the creation of a Palestinian state living side by side in peace and security with Israel. The creation of a Palestinian state can only be achieved through direct negotiations between the two parties.
We are encouraged, however, by the commitment of the Palestinians to the underlying principles of multilateral treaties.

Chile

Denmark

Withdrawal of declaration under article 92.
According to the four Nordic countries directly concerned (Finland, Denmark, Norway and Sweden), this withdrawal should be considered as a unilateral declaration which shall take effect in accordance with the second sentence of article 97(3), on the first day of the month following the expiration of six months after the date of its receipt by the depositary.
[...] in addition to the previous declaration made under Article 94 Denmark declares, in respect of Iceland in accordance with paragraph 1, in respect of Finland and Sweden in accordance with paragraph 1 cf. paragraph 3 and in respect of Norway in accordance with paragraph 2 that the Convention will not apply to the formation of contracts of sale where the parties have their places of business in Denmark, Iceland, Finland, Sweden or Norway.

Estonia

Finland

1. With reference to Article 92, Finland will not be bound by Part II of this Convention (Formation of the Contract).
2. With reference to Article 94, in respect of Sweden in accordance with paragraph (1) and otherwise in accordance with paragraph (2) the Convention will not apply to contracts of sale where the parties have their places of business in Finland, Sweden, Denmark, Iceland or Norway.

Germany

The Government of the Federal Republic of Germany holds the view that Parties to the Convention that have made a declaration under article 95 of the Convention are not considered Contracting States within the meaning of subparagraph (a) (b) of article 1 of the Convention. Accordingly, there is no obligation to apply - and the Federal Republic of Germany assumes no obligation to apply - this provision when the rules of private international law lead to the application of the law of a Party that has made a declaration to the effect that it will not be bound by subparagraph (1) (b) of article 1 of the Convention. Subject to this observation the Government of the Federal Republic of Germany makes no declaration under article 95 of the Convention.

Hungary

[The Hungarian People's Republic] considers the General Conditions of Delivery of Goods between Organizations of the Member Countries of the Council for Mutual Economic Assistance/GCD CMEA, 1968/1975, version of 1979/ to be subject to the provisions of article 90 of the Convention;
[The Hungarian People's Republic] states, in accordance with articles 12 and 96 of the Convention, that any provision of article 11, article 29 or Part II of the Convention that allows a contract of sale or its modification or termination by agreement or any offer, acceptance or other indication of intention to be made in any form other than in writing, does not apply where any party has his place of business in the Hungarian People's Republic.

Israel

The Permanent Mission of Israel to the United Nations presents its compliments to the Secretary-General of the United Nations, in his capacity as depositary of the United Nations Convention on Contracts for the International Sale of Goods, dated 11 April 1980, and has the honor to refer to the Palestinian request to accede to this Convention (Reference number C.N.804.2017.TREATIES-X.10).
‘Palestine’ does not satisfy the criteria for statehood under international law and lacks the legal capacity to join the aforesaid Convention both under general international law and the terms of bilateral Israeli-Palestinian agreements.
The Government of Israel does not recognize ‘Palestine’ as a State, and wishes to place on record, for the sake of clarity, its position that it does not consider ‘Palestine’ a party to the Convention and regards the Palestinian request for accession as being without legal validity and without effect upon Israel’s treaty relations under the Convention.

Laos

In accordance with article 95 of the United Nations Convention on Contracts for the International Sale of Goods (CISG), the Government of the Lao People’s Democratic Republic declares that it will not be bound by subparagraph (1) (b) of article 1 of the Convention and will apply the Convention to Contracts of Sale of Goods only between those parties whose place of business are in different States when the States are Contracting States.

Latvia

The Permanent Observer of the State of Palestine to the United Nations presents his compliments to the Secretary-General of the United Nations, in his capacity as Depositary, and has the honor to refer to depositary notification C.N.175.2018.TREATIES-XXVII.10, dated 4 April 2018, conveying a communication of the United States of America regarding the accession of the State of Palestine to the United Nations Convention to Combat Desertification in those Countries Experiencing Serious Drought and/or Desertification, particularly in Africa, 14 October 1994.
The Government of the State of Palestine regrets the position of the United States of America and wishes to recall United Nations General Assembly resolution 67/19 of 29 November 2012 according to which Palestine was accorded a ‘Non-member Observer State status in the United Nations’. In this regard, Palestine is a State recognized by the United Nations General Assembly on behalf of the international community.
As a State Party to the United Nations Convention to Combat Desertification in those Countries Experiencing Serious Drought and/or Desertification, particularly in Africa, 14 October 1994, which entered into force on 29 March 2018 for the State of Palestine, the State of Palestine will exercise its rights and honor its obligations with respect to all States Parties. The State of Palestine trusts that its rights and obligations will be equally respected by its fellow States Parties.

Saudi Arabia

Sweden

United States of America

The United States Mission to the United Nations presents its compliments to the Executive Office of the Secretary-General of the United Nations and refers to the U.N. Secretary-General’s depositary notification C.N.804.2017.TREATIES-X.10, dated January 2, 2018, regarding the purported accession of the ‘State of Palestine’ to the United Nations Convention on Contracts for the International Sale of Goods, done at Vienna April 11, 1980 (the Convention), for which the Secretary-General of the United Nations is the depositary.
The Government of the United States of America does not believe the ‘State of Palestine’ qualifies as a sovereign State and does not recognize it as such. Accession to the Convention is limited to sovereign States. Therefore, the Government of the United States of America believes that the ‘State of Palestine’ is not qualified to accede to the Convention and affirms that it will not consider itself to be in a treaty relationship with the ‘State of Palestine’ under the Convention.

Vietnam
