    Declaration by the Republic of Austria concerning provisional application pursuant to Article 318(2): Austria is willing to endorse the proposed approach, but must point out that, for constitutional reasons, it is able to provisionally apply the Enhanced Partnership and Cooperation Agreement between the European Union and its Member States, of the one part, and the Kyrgyz Republic, of the other part under international law only from the date on which it has notified the General Secretariat of the Council of the European Union, as the depositary of the Agreement, of the completion of its internal procedures governing the entry into force of the Agreement.

    DECLARATION OF THE EUROPEAN UNION ON THE RESPECT OF THE PRINCIPLE OF SOVEREIGNTY AND TERRITORIAL INTEGRITY OF ALL STATES CONSIDERING the obligations under customary international law, as reflected in Articles 40-41 of the 2001 Articles on the Responsibility of States for Internationally Wrongful Acts and UN Security Council Resolutions 541/1983 and 550/1984, which are binding upon all States, CONSIDERING that the decision taken by consensus, during the Summit of the Organisation of Turkic States, that took place in Samarkand on 11 November 2022, to grant observer status in the capacity of an entity to the secessionist entity in occupied Cyprus is contrary to international law, NOTING that the Joint Communiqué of the 19th European Union-Central Asia Ministerial Meeting expresses the continuing commitment to uphold the UN Charter and the fundamental principles of international law, in particular the respect for the independence, sovereignty and territorial integrity of all states including within the framework of all international and regional fora, NOTING that the Enhanced Partnership and Cooperation Agreement between the European Union and its Member States, of the one part, and the Kyrgyz Republic, of the other part, provides for the Parties the obligation to implement the Agreement on the basis of shared values, the principles of dialogue, mutual trust and respect, regional cooperation, effective multilateralism and respect for their international obligations arising from, in particular, their respective membership of the UN and the OSCE, DECLARES THE FOLLOWING: The principles of sovereignty and territorial integrity of all States, including the respect for UNSC resolutions 541 (1983) and 550 (1984), constitute international obligations arising from, in particular, UN membership.

    Declaration regarding the Provisional Application: On the basis of the respect of the competences allocated between the European Union and its Member States, as defined by the Treaties, the Decision of the Council that authorizes the provisional application, by the EU, of the Enhanced Partnership and Cooperation Agreement between the European Union and its Member States, of one part, and the Kyrgyz Republic, of the other part, shall not affect the autonomy of decision of Portugal on the issues of its national competence, whose decision to be bound by the Agreement depends on the conclusion of the internal ratification procedures, in accordance with the Constitutional principles and rules.
