    Objections Finland, 12-03-2025

    The Government of the Republic of Finland was pleased to learn that the Kingdom of Bhutan has become party to the Convention on the Rights of Persons with Disabilities (hereinafter ‘the Convention’). However, the Government of the Republic of Finland has carefully examined the reservations made by the Kingdom of Bhutan upon ratification of the Convention and is of the view that they raise certain concerns. The Government of the Republic of Finland considers that paragraph 1(a) and paragraph 2 of Article 18, paragraphs 1(b) and (c) of Article 23, paragraph 1(c) of Article 27, and section (a) (ii) of Article 29 concern fundamental principles of the Convention, and excluding the application of these provisions is contrary to the object and purpose of the Convention. Accordingly, the reservations made by the Kingdom of Bhutan are not permitted under Article 46, paragraph 1, of the Convention and Article 19 of the Vienna Convention on the Law of Treaties. Therefore, the Government of the Republic of Finland objects to the reservations. This objection does not preclude the entry into force of the Convention between the Republic of Finland and the Kingdom of Bhutan. The Convention will thus continue to operate between the two States without the Kingdom of Bhutan benefiting from the said reservations.

    Objections Malta, 13-03-2025

    The Government of the Republic of Malta has carefully examined the reservations made by the Kingdom of Bhutan upon ratification of the Convention on the Rights of Persons with Disabilities (the “Convention”), regarding paragraph l (a) and paragraph 2 of Article 18, paragraphs l (b) and (c) of Article 23, paragraph l (c) of Article 27, and section (a)(ii) of Article 29 of the Convention. The Government of the Republic of Malta considers that, contrary to the purpose of the Convention, “to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity”, this reservation restricts the full and equal enjoyment by persons with disabilities of certain human rights and fundamental freedoms outlined in the Convention. The Republic of Malta objects to the reservation as being incompatible with the object and purpose of the Convention, and consequently impermissible pursuant to Article 46(1) of the Convention and Article 19 of the Vienna Convention on the Law of Treaties. This objection shall not preclude the entry into force of the Convention between the Republic of Malta and the Kingdom of Bhutan.

    The Government of the Republic of Poland has examined the reservation by the Kingdom of Bhutan to the paragraph 1 (a) and paragraph 2 of Article 18, paragraphs 1 (b) and (c) or Article 23, paragraph 1 (c) of Article 27, and section (a) (ii) of Article 29 of the Convention on the Rights of Persons with Disabilities done in New York on December 13, 2006, made upon its ratification on march 13, 2024. The Government of the Republic of Poland considers that the reservation made by the Kingdom of Bhutan according to which it does not consider itself bound by paragraph 1 (a) and paragraph 2 of Article 18, paragraphs 1 (b) and (c) of Article 23, paragraph 1 (c) of Article 27, and section (a) (ii) of Article 29 of the Convention on the Rights of Persons with Disabilities is incompatible with the object and purpose of the Convention and therefore objects to it. This objection shall not preclude the entry into force of the Convention between the Republic of Poland and the Kingdom of Bhutan.

    The Government of the United Kingdom has examined the reservations made by the Kingdom of Bhutan, upon its ratification of the Convention, which read: Reservations ‘The Kingdom of Bhutan does not consider itself bound by paragraph 1(a) and paragraph 2 of Article 18, paragraphs 1(b) and (c) of Article 23, paragraphs 1(c) of Article 27 and section (a) (ii) of Article 29 of the United Nations Convention on the Rights of Persons with Disabilities.’ The purpose of the Convention, as set out in Article 1(1), is to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity. The United Kingdom considers that the reservations made by the Kingdom of Bhutan are contrary to this purpose as they restrict the full and equal enjoyment by persons with disabilities of certain human rights and fundamental freedoms covered by the Convention. The United Kingdom accordingly objects to the reservations as being incompatible with the object and purpose of the Convention. They are neither permitted under Article 46(1) of the Convention, nor Article 19 of the Vienna Convention of the Law of Treaties. This objection shall not prevent the entry into force of the Convention as between the Kingdom of Bhutan and the United Kingdom.

    Objections Austria, 07-03-2025

    The Government of Austria has carefully examined the reservation made by the Kingdom of Bhutan upon ratification of the Convention on the Rights of Persons with Disabilities on 13 March 2024. According to Article 46 paragraph 1 of the Convention, reservations contrary to the object and purpose of the Convention are impermissible. Austria finds that Article 18 paragraphs 1(a) and 2, Article 23 paragraphs 1(b) and (c), Article 27 paragraph 1(c), and Article 29 section (a) (ii) of the Convention relate to fundamental principles of the Convention and that the exclusion of the application of these principles is contrary to the object and purpose of the Convention. Austria therefore considers the reservation impermissible and objects to it. This objection shall not preclude the entry into force of the Convention between the Republic of Austria and the Kingdom of Bhutan.

    Objections Germany, 10-03-2025

    The Government of the Federal Republic of Germany has carefully examined the declaration made by the Kingdom of Bhutan upon ratification of the CRPD on 13 March 2024. The Government of the Federal Republic of Germany is of the opinion that the declaration constitutes a reservation insofar as it states that paragraph 1 (a) and paragraph 2 of Article 18, paragraph 1 (b) and (c) of Article 23, paragraph 1 (c) of Article 27 and section (a) (ii) of Article 29 of the Convention are not considered binding. Pursuant to paragraph 1 of Article 46 of the Convention, reservations are only permitted if they are not incompatible with the object and purpose of the Convention. The articles referred to relate to uniformly important rights of people with disabilities, such as protection from arbitrary deprivation of nationality, the rights of newborn children with disabilities, equality with regard to family matters and family planning, equality and participation in the labour market, and enjoyment of political rights, in particular their right to vote and to stand for election. Each of these provisions relates to the purpose of the Convention, set out in paragraph 1 of Article 1, to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity. The reservation made by the Kingdom of Bhutan is thus inconsistent with the stated guiding principles of the Convention and incompatible with its object and purpose. The Government of the Federal Republic of Germany therefore considers that the reservation is not permitted under Article 46 of the Convention and hereby objects to it. This objection shall not preclude the entry into force of the CRPD between the Federal Republic of Germany and the Kingdom of Bhutan.

    Objections Netherlands, the Kingdom of the, 11-03-2025

    The Government of the Kingdom of the Netherlands has carefully examined the reservation made by the Kingdom of Bhutan on 13 March 2024 upon ratification of the United Nations Convention on the rights of persons with disabilities. The Government of the Kingdom of the Netherlands notes that the Kingdom of Bhutan does not consider itself bound by paragraph 1(a) and paragraph 2 of Article 18, paragraphs 1(b) and (c) of Article 23, paragraph 1(c) of Article 27, and section (a) (ii) of Article 29 of the Convention. The Government of the Kingdom of the Netherlands considers that such a reservation, which seeks to limit the responsibilities of the reserving State under the Convention, raises doubts as to the commitment of that State to the object and purpose of the Convention. The reservation excludes the application of many essential rights covered by the Convention and thereby restricts the full and equal enjoyment by persons with disabilities of those rights. The reservation is therefore incompatible with the Convention’s object and purpose. Moreover, article 46 of the Convention explicitly states that reservations incompatible with its object and purpose shall not be permitted. The Government of the Kingdom of the Netherlands recalls that, according to article 46 of the Convention and according to customary international law as codified in article 19 (c) of the Vienna Convention on the Law of Treaties, reservations incompatible with the object and purpose of a Convention are not permissible. The Government of the Kingdom of the Netherlands therefore objects to the reservation of the Kingdom of Bhutan to the Convention. This objection shall not preclude the entry into force of the Convention between the Kingdom of the Netherlands and the Kingdom of Bhutan.

    Objections Norway, 11-03-2025

    The Government of Norway has carefully examined the reservation made by the Government of the Kingdom of Bhutan upon ratification of the Convention on the Rights of Persons with Disabilities of 13 December 2006, in which ‘[t]he Kingdom of Bhutan does not consider itself bound by paragraph 1(a) and paragraph 2 of Article 18, paragraphs 1(b) and (c) of Article 23, paragraphs 1(c) of Article 27, and section (a) (ii) of Article 29 of the United Nations Convention on [the] Rights of Persons with Disabilities.’ The Government of Norway is of the opinion that paragraph 1(a) and paragraph 2 of Article 18, paragraphs 1(b) and (c) of Article 23, paragraphs 1(c) of Article 27, and section (a) (ii) of Article 29 of the Convention on the Rights of Persons with Disabilities, are related to fundamental principles of the Convention. The Government of Norway considers that the exclusion of the application of these provisions is contrary to the object and purpose of the Convention, and that the reservation is impermissible under Article 46, paragraph 1 of the Convention. It is in the common interest of States that treaties to which they have chosen to become Parties are respected, as to their object and purpose, by all Parties. The Government of Norway therefore objects to the aforesaid reservation. This objection shall not preclude the entry into force of the Convention between the Government of Norway and the Kingdom of Bhutan. The Convention thus becomes operative between the Government of Norway and the Kingdom of Bhutan, without [t]he Kingdom of Bhutan benefitting from its aforementioned reservation.

    Objections Romania, 10-03-2025

    Romania has carefully examined the reservation made by the Kingdom of Bhutan upon ratification on 13 March 2024 of the Convention on the Rights of Persons with Disabilities (the ‘Convention’), concerning paragraph 1 (a) and paragraph 2 of Article 18, paragraphs 1 (b) and (c) of Article 23, paragraphs 1 (c) of Article 27 and section (a) (ii) of Article 29 of the Convention. Romania considers that, contrary to the object and purpose of the Convention to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities without discrimination of any kind on the basis of disability (Articles 1, 3, 4 and 5 of the Convention), this reservation restricts the full and equal enjoyment by persons with disabilities of various human rights and fundamental freedoms in areas covered by the Convention. Therefore, the reservation is incompatible with the object and purpose of the Convention and hence impermissible according to Article 46 (1) of the Convention and Article 19 of the Vienna Convention on the Law of Treaties. Romania thus objects to the aforementioned reservation made by the Kingdom of Bhutan. This objection shall not preclude the entry into force of the Convention between Romania and the Kingdom of Bhutan, without the Kingdom of Bhutan benefitting from its reservation.

    Objections Sweden, 11-03-2025

    The Government of Sweden has examined the contents of the reservations made by the Kingdom of Bhutan upon ratification, on 13 March 2024, of the Convention on the Rights of Persons with Disabilities, done at New York on 13 December 2006, (‘the Convention’). The Government of Sweden believes that the reservations made by Bhutan limit the ability of persons with disabilities to fully and equally enjoy certain human rights in areas covered by the Convention. Accordingly, the reservations are incompatible with the object and purpose of the Convention and thus impermissible according to Article 46(1) of the Convention and Article 19 of the Vienna Convention on the Law of Treaties. The Government of Sweden objects to the reservations made by the Kingdom of Bhutan. This objection shall not preclude the entry into force of the Convention between Sweden and the Kingdom of Bhutan.

    Objections Switzerland, 07-03-2025

    The Swiss Federal Council has examined the reservations made by Bhutan upon ratification of the Convention on the Rights of Persons with Disabilities of 13 December 2006: “The Kingdom of Bhutan does not consider itself bound by paragraph 1(a) and paragraph 2 of Article 18, paragraphs 1(b) and (c) of Article 23, paragraph 1(c) of Article 27, and section (a) (ii) of Article 29 of the United Nations Convention on the Rights of Persons with Disabilities.” Under article 46 (1) of the Convention, no reservations may be made to the provisions of the Convention. The reservations made by Bhutan go beyond what is permitted by the Convention. It is in the common interest of States that instruments to which they have chosen to become parties are respected by all parties and that States are prepared to comply with their treaty obligations. The Swiss Federal Council therefore objects to the reservations made by Bhutan. This objection shall not preclude the entry into force of the Convention between Switzerland and Bhutan.

    … the Government of the United Kingdom hereby extends the application of its ratification of the [Convention on the Rights of Persons with Disabilities (UNCRPD)], with the reservations and interpretative declaration which currently apply for the United Kingdom, to the territory of Bermuda, for whose international relations the United Kingdom is responsible. … The Government of the United Kingdom considers the extension of the UNCRPD to Bermuda to take effect on the date of deposit of this notification... In addition, the Government of the United Kingdom hereby notifies … that the following interpretative declaration and reservation for Article 12, relating to supported and substituted decision making, will apply to the territory of Bermuda only: Bermuda recognises that persons with disabilities enjoy legal capacity on an equal basis with others in all aspects of life. Bermuda declares its understanding that the Convention permits supported and substitute decision-making arrangements which provide for decisions to be made on behalf of a person, where such arrangements are necessary, in accordance with the law, and subject to appropriate and effective safeguards. To the extent article 12 may be interpreted as requiring the elimination of all substitute decision making arrangements, Bermuda reserves the right to permit such arrangements in appropriate circumstances and subject to appropriate and effective safeguards.
