In accordance with Article 2 § 1 of Appendix A of COTIF and in accordance with Article 2 § 1 of Appendix E of COTIF in the version of the Annex to this Protocol, the Republic of Austria reserves the right not to apply the whole of the provisions concerning the liability of the carrier in case of death of, or personal injury to, passengers when the accident has occurred on its territory and when such passengers are Austrian nationals or have their usual place of residence in Austria.

Carriage by Rail (COTIF), the Republic of Azerbaijan reserves the right not to apply
§ 1 and § 2 of Article 28 of COTIF.
Application of CIV UR only to part of a Member State's railway network
- In accordance with Article 1 § 6 of the Uniform Rules concerning the Contract
of International Carriage of Passengers by Rail (CIV – Appendix A to the Convention),
the Republic of Azerbaijan will apply these Uniform Rules on the Baku – Boyuk-Kesik
railway line (505 km), after the new Baku–Tbilisi– Kars railway line is put into operation.
Application of CIM UR only to part of a Member State's railway network
- In accordance with Article 1 § 6 of the Uniform Rules concerning the Contract
of International Carriage of Goods by Rail (CIM – Appendix B to the Convention), the
Republic of Azerbaijan will apply these Uniform Rules on the following railway lines:
- The Baku – Boyuk-Kesik railway line (505 km), after the new Baku–Tbilisi–Kars railway
line is put into operation;
- The railway line (6 km) between the Ayat Port and the Alyat railway station, after
this line is put into operation.
Non-application of certain Appendices in their entirety
- In accordance with Article 42 § 1 of COTIF, the Republic of Azerbaijan reserves
the right not to apply the following Appendices:
– Uniform Rules concerning Contracts of Use of Vehicles in International Rail Traffic
(CUV – Appendix “D” to the Convention);
– Uniform Rules concerning the Contract of Use of Infrastructure in International
Rail Traffic (CUI – Appendix “E” to the Convention);
– Uniform Rules concerning the Validation of Technical Standards and the Adoption
of Uniform Technical Prescriptions applicable to Railway Material intended to be used
in International Traffic (APTU – Appendix “F” to the Convention);
– Uniform Rules concerning the Technical Admission of Railway Material used in International
Traffic (ATMF – Appendix “G” to the Convention).
Czech Republic

Arbitration
The Czech Republic, successor state of Czechoslovakia, maintained the reservations
expressed by Czechoslovakia concerning arbitration.
1. By virtue of § 3 of Article 12 of the Convention, the Czech Republic does not consider
itself bound by the provisions of § 1 and § 2 of this Article.
2. Reservation in accordance with Article 28 § 3 of COTIF 1999.
The Czechoslovak Socialist Republic, in accordance with Article 12, § 3 of the Convention
concerning International Carriage by Rail (COTIF), concluded at Berne on 9 May 1980,
will not apply Article 12, § 1 thereof and, in accordance with Article 3, § 1 of Appendix
A - CIV Uniform Rules, will not apply to passengers involved in accidents occurring
in its territory the whole of the provision concerning the liability of the railway
in case of death or of personal injury to passengers, when such passengers are nationals
of the Czechoslovak Socialist Republic or have their usual place of residence in the
Czechoslovak Socialist Republic.
The Czech Republic and the Slovak Republic, successor states of Czechoslovakia, maintained
the reservations expressed by Czechoslovakia, however provided that the reservation
in accordance with Article 3, §1 of Appendix A concerns respectively Czech or Slovak
nationals and people with their usual place of residence in the Czech Republic or
the Slovak Republic.
Estonia

Application of CIV UR only to part of a Member State's railway network
Pursuant to Article 24 of the Convention and paragraph 6 of Article 1 of Appendix
A "Uniform Rules concerning the Contract of International Carriage of Passengers by
Rail" (CIV) to the Convention, the Republic of Estonia will apply Appendix A to the
Convention to the international carriage of passengers by rail performed only on the
railway line Tallin-Tapa-Valga in both directions.
Application of CIM UR only to part of a Member State's railway network
Pursuant to Articles 3 and 24 of the Convention and paragraph 6 of Article 1 of Appendix
B 'Uniform Rules concerning the Contract for International Carriage of Goods by Rail'
(CIM) to the Convention, the Republic of Estonia will apply Appendix B to the Convention
to the international carriage of goods by rail performed only on the railway line
Tallin-Tapa-Valga in both directions and the point of departure or the point of destination
of which is situated on the territory of a state, with whom it has not been agreed
otherwise regarding such carriage.
Georgia

In accordance with paragraph 3 of Article 28 of the Convention concerning International
Carriage by Rail (hereafter referred to as "Convention"), Georgia retains the right
not to apply in whole § 1 and § 2 of Article 28.
Application of CIV UR only to part of a Member State's railway network
In accordance with Article 24 of the Convention and with § 6 of Article 1 of the Uniform
Rules concerning the Contract of International Carriage of Passengers by Rail (CIV)
Appendix "A" to the Convention, Georgia retains the right to apply these uniform rules
to the international carriage of passengers only on the section from the station Gardabani
to the station Kartsakhi, to the state border (244 km), after this line is put into
operation.
Application of CIM UR only to part of a Member State's railway network
In accordance with Article 24 of the Convention and with § 6 of Article 1 of the Uniform
Rules concerning the Contract of International Carriage of Goods by Rail (CIM), Appendix
"B" to the Convention, Georgia retains the right to apply these uniform rules to the
international carriage of goods on the following sections of the railway infrastructure
of Georgia:
a) The section from "Poti" Port - to "Poti" Railway Station - 2,7 km;
b) The section from "Batumi" Port - to "Batumi" Railway Station - 1,9 km;
c) The section from Gardabani to the station Kartsakhi, to the state border - 244
km (after it is put into operation).
Non-application of certain Appendices in their entirety
In accordance with § 1 of Article 42 of this Convention, Georgia shall not apply in
whole the following Appendices:

In accordance with paragraph 1 of Article 2 of the Uniform Rules of International
Carriage of Passengers by Rail (CIV - Appendix A to the Convention concerning International
Carriage revised by Protocol of 3 June 1999) the Republic of Latvia declares that
it will not apply to passengers involved in accidents occurring on its territory the
whole of the provisions concerning the liability of the carrier in case of death of,
or personal injury to, passengers, when such passengers are nationals of, or have
their usual place of residence in, that State.
Pakistan

Portugal

The reservation made by Portugal in accordance with Article 12 § 3 of COTIF 1980 also
applies in respect of COTIF 1999, see Article 28 § 3 of COTIF 1999
1. In accordance with Article 12 § 3 of COTIF, the recourse to the arbitration will
not be admitted for the settlement of disputes arising from the application of the
CIV Uniform Rules or the CIM Uniform Rules in accordance with § 2 of this Article.
2. In accordance with Article 3 § 1 of the CIV Uniform Rules, the whole provisions
concerning the liability of the railway will not apply in case of death of or personal
injury to passengers where the accident occurs in Portuguese territory and the passenger
is a Portuguese national or is normally resident in Portugal.
In accordance with Article 12 § 3 of COTIF, the recourse to the arbitration will not
be admitted for the settlement of disputes arising from the application of the CIV
Uniform Rules or the CIM Uniform Rules in accordance with § 2 of this Article.
Romania

The reservation made by Romania in accordance with Article 12 § 3 of COTIF 1980 also
applies in respect of COTIF 1999, see Article 28 § 3 of COTIF 1999.
a) The Socialist Republic of Romania declares that it does not deem itself bound by
the provisions of Article 12 § 1 of the Convention, which state that any dispute between
the contracting parties concerning the interpretation or application of the Convention
may be referred for settlement by arbitration at the request of one of the parties.
The Socialist Republic of Romania considers that such disputes may be referred to
arbitration only with the agreement, in each individual case, of all the parties to
the dispute.
b) The Socialist Republic of Romania declares that it does not deem itself bound by
provisions of those of the Uniform Rules concerning the Contract for International
Carriage of Passengers and Luggage by Rail which relate to the liability of the railway
in case of death of or personal injury to passengers involved in accidents occurring
in its territory, where such passengers are Romanian citizens or have their usual
place of residence in the Socialist Republic of Romania.
Russian Federation

In accordance with Article 28 § 3 of the Convention concerning International Carriage
by Rail (COTIF), the Russian Federation reserves the right not to apply § 1 and §
2 of Article 28 of COTIF.
Application of CIM UR only to part of a Member State's railway network
In accordance with Article 1 § 6 of the Uniform Rules concerning the Contract of International
Carriage of Goods by Rail (CIM) (Appendix B to the Convention concerning International
Carriage by Rail (COTIF)), the Russian Federation will apply Appendix B to the carriage
performed on the parts of the railway infrastructure from the landing stage of the
ferry terminal Baltiysk to the near-port railway station Baltiysk (2.84 km) and from
the landing stage of the ferry terminal Ust-Luga to the near-port railway station
Luzhskaya (1.745 km).
Non application of certain Appendices in their entirety
In accordance with Article 42 § 1 of the Convention concerning International Carriage
by Rail (COTIF), the Russian Federation reserves the right not to apply the Appendices
A, C, D, E, F, G to COTIF.

The reservation concerning arbitration made by Ukraine in accordance with Article

In accordance with Article 12 § 3 of Article 12 of the Convention, Ukraine does not
consider itself bound by the provisions of § 1 and § 2 of this Article.
Liability in case of death or injury (CIV UR and CUI UR).
1. According to paragraph 1 of Article 2 of the Uniform Rules concerning the Contract
of International Carriage of Passengers by Rail (CIV – Appendix A to the Convention),
the Ukraine reserves its right not to apply to passengers who become victims of an
accident on the territory of the Ukraine the whole of the provisions concerning the
liability of the carrier in case of death of, or personal injury to, passengers, if
they are nationals of the Ukraine or if the Ukraine is their permanent place of residence;
2. According to paragraph 1 of Article 2 of the Uniform Rules concerning the Contract
of Use of Infrastructure in International Rail Traffic (CUI – Appendix E to the Convention),
the Ukraine reserves its right not to apply the whole of the provisions on liability
in case of corporal injuries to the victims of an accident which occurs in the territory
of the Ukraine, if the victims are nationals of the Ukraine or if the Ukraine is their
permanent place of residence.

3. According to Article 1 § 6 of the Uniform Rules concerning the Contract of International
