This Agreement or any measure taken in compliance therewith shall be applied taking into account the legal position of the Kingdom of Spain on the territory of Gibraltar, as well as on the isthmus and the airport built on it. The Kingdom of Spain wishes to reiterate that the airport of Gibraltar is located in a territory, the isthmus, which is not among the spaces ceded to the United Kingdom by virtue of the Treaty of Utrecht of 1713, but is illegally occupied by the latter State. The application of this Agreement to Gibraltar airport shall be suspended until Spain notifies the European Union of the lifting of the suspension, in accordance with the legal position of the Kingdom of Spain with regard to the territory of Gibraltar, and with regard to the isthmus and the airport built upon it.
